According to the announcement, the facility to pay online will be available from July 2013. \u00a0This suggests that the new fee structure proposed shall be introduced then.<\/p>\n<\/div>\n<div>At the moment it costs nothing to bring an employment tribunal claim, but following consultation in 2011 the government is introducing the new fee structure so as to be in line with other court processes where fees are paid. \u00a0Currently it costs \u00a384m to run the tribunal system funded by the tax payer; the government aims to reduce this burden whilst still promoting justice for all. \u00a0However many on low incomes are not required to pay full court fees so the government will be reviewing this for employment tribunal claims.<\/div>\n<div>The introduction of fees is part of the government&#8217;s plan to promote early resolution encouraging people to look for alternatives to \u00a0using the court system. \u00a0Alternatives would be mediation, ACAS conciliation or directly negotiated settlement.<\/div>\n<div>Fees will be payable in advance and there will be a two stage process; a fee will be paid to start a claim off and another fee will be due to be able to go forward with a hearing should that be necessary. \u00a0The level of fee will be dependent on the type of claim being brought. \u00a0For level 1 claims that include unlawful deductions, holiday pay, notice pay, redundancy pay the issue fee shall be \u00a3160 with \u00a3230 hearing fee. \u00a0For level 2 claims that include unfair dismissal and discrimination the issue fee shall be \u00a3250 and hearing fee \u00a3950.<\/div>\n<div><span>In cases where more than one claimant is bringing the same claim the fee structure makes provision for this and has suggested fees accordingly.\u00a0<\/span><\/div>\n<\/div>\n<h4>Level 1 claims<\/h4>\n<table border=\"1\">\n<tbody>\n<tr>\n<th>Fee Type<\/th>\n<th>Two to ten claimants<\/th>\n<th>11 to 200 claimants<\/th>\n<th>201 or more claimants<\/th>\n<\/tr>\n<tr>\n<td>Issue fee<\/td>\n<td>\u00a3320<\/td>\n<td>\u00a3640<\/td>\n<td>\u00a3960<\/td>\n<\/tr>\n<tr>\n<td>Hearing fee<\/td>\n<td>\u00a3460<\/td>\n<td>\u00a3920<\/td>\n<td>\u00a31,380<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h4>Level 2 claims<\/h4>\n<table border=\"1\">\n<tbody>\n<tr>\n<th>Fee Type<\/th>\n<th>Two to ten claimants<\/th>\n<th>11 to 200 claimants<\/th>\n<th>201 or more claimants<\/th>\n<\/tr>\n<tr>\n<td>Issue fee<\/td>\n<td>\u00a3500<\/td>\n<td>\u00a31,000<\/td>\n<td>\u00a31,500<\/td>\n<\/tr>\n<tr>\n<td>Hearing fee<\/td>\n<td>\u00a31,900<\/td>\n<td>\u00a33,800<\/td>\n<td>\u00a35,700<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<div>With the Employment Appeal Tribunal the issue fee shall be \u00a3400 and hearing fee \u00a31200.<\/p>\n<div><\/div>\n<p>Other fees linked to the process are as follows:<\/p>\n<\/div>\n<ul>\n<li><span>An application to set aside a default judgement<\/span><span>\u00a0<\/span>\u2013 The fee would be \u00a3100 which would be payable by the respondent.<strong><\/strong><\/li>\n<li><span>An application to dismiss a claim following settlement or withdrawal<\/span><span>\u00a0<\/span>\u2013 The fee would be \u00a360 although it has been recommended that when a party withdraws their claim the respondent should not have to pay to get their claim dismissed.<\/li>\n<li><span>An application for judicial mediation<\/span><span>\u00a0<\/span>\u2013 The fee would be \u00a3600 and is payable by the employer.<b><\/b><\/li>\n<li><span>A breach of contract counter claim<\/span><span>\u00a0<\/span>\u2013 The fee would be \u00a3160 payable by the employer.<b><\/b><\/li>\n<li><span>An application for a review of a tribunals decision or judgement<\/span><span>\u00a0<\/span>\u2013 The fee for this would be \u00a3100 for level one claims and \u00a3350 for level two claims.<\/li>\n<\/ul>\n<div><span><span>Need employment law advice see our website\u00a0<a href=\"http:\/\/www.sjbealehrconsult.co.uk\/\">www.sjbealehrconsult.co.uk<\/a><\/span><\/span><\/div>\n<div><\/div>\n<h3><\/h3>\n","protected":false},"excerpt":{"rendered":"<p>The Ministry of Justice has announced that it is introducing an online service for the payment of employment tribunal fees.
