Employment Tribunal Representation

Since employment tribunal fees were abolished in March 2018 the number of claims are once again increasing. The latest employment tribunal statistics show most of the claims related to unpaid wages and holiday pay. Claims may set to increase with the Labour Government's proposal to allow unfair dismissal claims from day one of employment.

 

An employment tribunal can be costly and very stressful for an employer. It is, therefore, important if you are unfamiliar with the process to be effectively represented at an employment tribunal. The process is a very lengthy and time consuming process taking sometimes up to 12 months. The deadlines set by the employment tribunal system have to be complied with and the maze of bureaucrasy and paperwork dealt with. We offer a full employment tribunal representation service or you may to handle parts of the claim youself. We can assist with the paperwork, ACAS and third parties. We can negotiate a settlement on our behalf, handle a pre hearing review, case management discussion, an employment tribunal hearing or employment appeals tribunal hearing.

We have many years experience of the employment tribunal system managing claims related to unfair dismissal, constructive dismissal, discrimination, unlawful deduction of salary and breach of contract

Many cases will settle via the four week week obligatory ACAS conciliation process. Claims may not proceed to an employment tribunal until this process has concluded and the concilation certificate issued to the claimant. It may however be possible to settle as the claim proceeds. We have even settled claims on the morning of an employment tribunal hearing. Should the claim proceed to an employment tribunal it can take 6 to 12 months.

Take initial instructions, review of the papers and advise on merits and likely compensation
Enter into ACAS Early Conciliation to explore whether a settlement can be reached via a COT3;
Prepare a Claim (ET1) or Response (ET3)
Review and advise on a Claim or Response
Explore settlement and negotiate settlement terms throughout the process
Prepare a schedule of loss

Prepare for and attend a Preliminary Hearing or Case Management Hearing
Exchange documents with the other party and agree a bundle of documents
Draft statements and agree their content with witnesses
Prepare bundles of documents
Review and advise on the other party’s witness statements
Agree a list of issues, a chronology and/or cast list
Prepare and attend at an employment tribunal hearing

Fees can be reduced if some of these stages are not needed or you wish to handle part of the claim yourself. However higher fees are changed were we have to defend discrimination linked to dismissal, manage preliminary issues such as if the claim has been presented out of time or the claimant is disabled, make a costs application, manage a large number of documents and witnesses.
